Raja Berperlembagaan: Prinsip dan Amalannya di Malaysia

ABSTRAK

Umum kelihatannya beranggapan bahawa konsep raja berperlembagaan Malaysia berinspirasikan demokrasi Westminster. Ini kurang tepat kerana apa yang dianggap sebagai raja berkuasa mutlak dalam ertikata yang sebenar sebenarnya tidak wujud dan semua raja - termasuk Raja-Raja Melayu sebelum pentadbiran British - pada hakikatnya tertakluk kepada nilai dan batasan tertentu. Dalam konteks perlembagaan sekarang pun raja berperlembagaan kita tidak sepenuhnya menyalin apa yang ada di United Kingdom. Walaupun terdapat ciri-ciri yang bersifat sejagat tetapi terdapat juga beberapa faktor yang menyebabkan konsep raja berperlembagaan di Malaysia tersendiri dan mengekal keunikannya.

Constitutional Monarchy: Principles and Its Practicality in Malaysia

 

ABSTRACT

The general masses have the perception that the constitutional monarchy concept in Malaysia was inspired along the Westminster democracy. This is quite incorrect because what has been perceived as the king with absolute power in totality does not actually exist – including those of the Malay kings before the British administration – in fact it was subject to specified values and limitations. Even within the context of the current constitutions we never duplicate what exists in the United Kingdom. Although there exist characteristics with global features but there are also various factors that caused the constitutional monarchy concept in Malaysia to stand on its own and maintain its uniqueness.
